These Terms and Conditions (“Terms”) govern your use of the craftysmile.co.uk website (the “Platform”) as a visitor, buyer (“Buyer”), or seller (“Seller” or “you”). The Platform is operated by craftysmile.co.uk (“we”, “us”, or “craftysmile.co.uk”).By browsing, registering, buying, or selling on the Platform, you agree to be bound by these Terms, our Privacy Policy, and any other policies we publish.
- Our Role as a Marketplace
• craftysmile.co.uk operates an online marketplace facilitating sales of handmade craft items, craft equipment, supplies, materials, and related products (collectively, “Craft Products”) between Sellers and Buyers.
• We are not a party to the contract of sale between you and the Buyer/Seller. The contract is directly between the Seller (as the supplier) and the Buyer.
• We do not take title to, inspect, or warrant any products listed. All responsibility for the products, including quality, safety, description, delivery, and compliance with law, rests solely with the Seller. - Eligibility and Account
• You must be at least 18 years old to register as a Seller or Buyer (or have parental consent if 13–17 for browsing/buying).
• You are responsible for keeping your login details secure.
• Only individuals and businesses with a permanent UK address (England, Scotland, Wales, or Northern Ireland) may register as Sellers. Sellers based outside the United Kingdom are not permitted.
• We may suspend or terminate accounts for any breach, suspected fraud, or illegal activity. - Seller Registration and Obligations
• You must provide accurate, complete, and up-to-date information during registration, including your full name, address, contact details, and business status (e.g., private individual or trader).
• You warrant that:
• You are legally capable of entering into binding contracts.
• All information provided is true and accurate.
• You are UK-established (based in the UK) and selling goods located in the UK at the point of sale.
• Your products are lawful Craft Products, genuinely owned by you, and do not infringe third-party rights (including intellectual property, trademarks, or copyrights).
• You must not list prohibited or restricted items, including but not limited to: illegal goods, counterfeit or replica items, weapons, hazardous materials, adult-only items, live animals, drugs, alcohol, tobacco, offensive/obscene content, or any items that infringe intellectual property rights (full prohibited list available on the Platform if published). - Tax and VAT Responsibilities
• You are solely responsible for all tax obligations arising from your sales on the Platform, including but not limited to income tax, National Insurance, and Value Added Tax (VAT).
• Most Craft Products are subject to the standard rate of VAT (currently 20%).
• If your taxable turnover exceeds the current UK VAT registration threshold, you must register for VAT with HMRC, charge VAT on your sales, and account for it on your VAT returns.
• You must monitor your own turnover and comply independently. craftysmile.co.uk does not collect, charge, or remit VAT on your behalf for UK-to-UK sales.
• You agree to provide evidence of your VAT status or compliance if requested by us or authorities.
• You indemnify craftysmile.co.uk against any liability, claims, penalties, or costs arising from your failure to comply with tax laws or any other UK legislation, including any misrepresentation of your business status or VAT obligations.
• You must immediately notify us if your circumstances change (e.g., you become VAT-registered or start trading as a business). - Compliance with Consumer and Other Laws
• You must comply with all applicable UK laws, including:
• Consumer Rights Act 2015: If you are acting as a trader (i.e., selling in the course of business, including if your volume or pattern of sales indicates trading activity), goods must be of satisfactory quality, as described, fit for purpose, and match any sample/model. Buyers have rights to repair/replacement, refund, or price reduction for breaches.
• Product Safety: Goods must be safe and comply with relevant standards (e.g., under the General Product Safety Regulations 2005).
• Distance Selling: If you are acting as a trader, you must provide clear pre-contract information to Buyers, honour the 14-day cancellation right for consumer Buyers where applicable, and handle returns/refunds in accordance with the Consumer Contracts Regulations 2013. Private (non-trader) sellers have more limited obligations but must not misrepresent goods.
• Online Safety Act 2023: Do not post illegal or harmful content in listings or communications.
• UK GDPR and Data Protection Act 2018: You are responsible for handling any personal data of Buyers lawfully and securely.
• You confirm and warrant that you will comply with all legal obligations that apply to you based on your status as a private seller or trader.
• We may suspend or terminate your account if we believe you are in breach. - Listings, Orders, Fulfilment, Shipping, and Delivery
• You are responsible for accurate listings, pricing (inclusive of any VAT you must charge), stock levels, and order fulfilment.
• You must dispatch orders promptly (within 5 working days recommended; tracked shipping mandatory for orders over £25) and provide tracking where applicable.
• Sellers are responsible for safe packaging and correct postage. Risk passes to the Buyer on delivery.
• You must handle all customer enquiries, complaints, returns, refunds, disputes, and chargebacks directly. In the event of a chargeback or dispute, you authorise us to refund the Buyer from any funds held on your behalf if we deem it necessary to comply with payment provider rules or law.
• Orders can be cancelled free of charge before the Seller marks the item as dispatched. - Buyer Protection and Returns
• Buyers should contact the Seller directly as soon as possible (ideally within 48 hours of delivery) to report any problem with an order. The contract of sale is between the Buyer and the Seller only, and craftysmile.co.uk is not a party to it. The platform will not generally intervene in communications or disputes relating to individual sales.
• Lost or Delayed Postage: Once an item has been dispatched by the Seller and proof of postage or tracking information has been provided, the risk of loss, damage, or delay during transit passes to the Buyer. craftysmile.co.uk and the Seller shall not be responsible for items that are lost, damaged, or delayed by the postal or courier service. In such cases:
• If tracking shows the item as delivered, no refund will be due from the Seller.
• If the item is shown as lost or undelivered after a reasonable period (typically 28 working days for UK domestic post), the Seller is encouraged (but not obliged) to offer a resolution such as a refund or replacement unless legislation applies in the case of traders.
• Buyers & Sellers are recommended to agree tracked or signed-for delivery options for higher-value orders.
• If an item is not received, not as described, significantly faulty, or counterfeit:
• Sellers acting as traders must comply with their legal obligations under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013. This may include providing a full refund (including original delivery costs) and, in certain circumstances, reimbursing the Buyer for reasonable return postage costs.
• Private (non-trader) sellers are not subject to the same statutory obligations but are strongly encouraged to offer a fair resolution for genuine issues (e.g., refund or replacement) and must not misrepresent items.
• In the event of an unresolved dispute, Buyers may open a case through their payment provider or seek advice from consumer protection bodies. We may, at our sole discretion, assist by providing order details or issuing a refund from held funds if we determine the claim is clearly valid.
• Returns or refunds for “change of mind” or other non-fault reasons are entirely at the Seller’s discretion, unless the Seller is acting as a trader and the Buyer is a consumer exercising their statutory 14-day cooling-off right. - Fees and Payments
• We charge a commission of 9% of the total sale amount (including shipping charged to the Buyer, but excluding any VAT you are required to charge) plus 30p per transaction.
• A withdrawal fee of 30p will be deducted from each payout you request (£5 minimum withdrawal & 5 day minimum threshold applies).
• Our fees are exclusive of VAT (we are not currently VAT-registered).
• Payments are processed via PayPal or other provider as occasion arises.
• You authorise us to deduct payment provider fees, our commission, transaction fees, withdrawal fees, and any other applicable charges from payments received on your behalf before transferring the remaining balance to you. - Intellectual Property
• You grant us a worldwide, royalty-free, non-exclusive licence to use, display, and promote your listing photos, descriptions, and content.
• You warrant that you own or have rights to all content you upload and that it does not infringe third-party IP rights. - Prohibited Conduct
• You must not harass or threaten other users, create multiple accounts to evade fees or bans, deal off-platform to avoid commission, or manipulate feedback/ratings.
• Breaches may result in permanent bans. - Misrepresentation, Indemnity, and Limitation of Our Liability
• If you misrepresent yourself (e.g., your business status, product descriptions, or origin), or fail to comply with any legal obligations, you will be solely liable for any resulting claims, fines, or losses and our costs.
• You agree to fully indemnify, defend, and hold harmless craftysmile.co.uk, its owners, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your listings, products, sales, or breach of these Terms.
• The Platform is provided “as is”. We are not responsible for the quality, safety, or legality of items sold.
• To the fullest extent permitted by law, craftysmile.co.uk excludes liability for any loss or damage, including indirect/consequential losses. We are not liable for disputes between you and Buyers/Sellers.
• Our total liability to any user is limited to the fees earned from that user in the previous 12 months. - Privacy and Data Protection
• Your personal data is processed in accordance with our Privacy Policy. We may share limited data with Buyers/Sellers for fulfilment and with authorities where required by law. - Dispute Resolution, Changes to Terms, and Termination
• First, contact us for any disputes. If unresolved, UK users may refer to alternative dispute resolution or the courts.
• We may update these Terms from time to time. We will notify registered users of material changes via email or the Platform. Continued use constitutes acceptance.
• We may suspend or terminate your account at any time for breach of these Terms, with or without notice. Upon termination, you must fulfil outstanding orders. - Governing Law
• These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
